Ukraine Implements Technical Regulations on Data Cryptographic Protection Facilities

The Resolution of the Cabinet of Ministers of Ukraine “On the approval of the Technical Regulations on data cryptographic protection facilities” will come into force in Ukraine on January 1, 2022.

This Resolution enacts the Technical Regulations on data cryptographic protection facilities as well as sets terms for its implementation with regard to facilities that are already presented in the Ukrainian market. According to the Resolution, data cryptographic protection facilities that have been put into operation or appeared on the market before the enforcement of this Resolution should not be withdrawn or banned until January 1, 2027.

Cryptographic protection is confirmed either by an expert opinion in the field of cryptographic information protection or by a document of compliance. State market supervision over data cryptographic protection facilities will be carried out by the Administration of the State Service for Special Communications and Information Protection of Ukraine.

Thus, the data cryptographic protection facilities which will be put into operation or supplied to the Ukrainian market after January 2022 will have to undergo a state expert review against the national requirements of Ukraine.
