Serbia Is Going to Implement Amendments to EMC and LVD Rulebooks Soon

The GMA Consult Group reminds our subscribers that amendments to LVD and EMC Rulebooks will become effective from January 1, 2022 in Serbia. 

The Rulebook on electromagnetic compatibility prescribes:

  • the essential requirements for electromagnetic compatibility and other requirements that must be met by equipment delivered to the Serbian market
  • presumption of conformity
  • apparatus conformity assessment procedures
  • content of technical documentation
  • mark of conformity and marking of conformity
  • declaration of conformity and model declaration of conformity
  • requirements to be met by the conformity assessment body and safeguard clause


In the original version of the Rulebook, the Serbian Ministry of Economy permits to deliver appliances that are not  CE-marked but follow the EMC rulebook and were in the suppliers' stocks at the date of entry into force of the ACAA Agreement. Starting from January 1, 2022, appliances without the CE mark could not be put to the market of Serbia anymore.

At the same time, the Ministry informs that at the day of entry into force of the ACAA agreement or, if that agreement is not concluded, at the day of accession of the Republic of Serbia to the European Union the national conformity mark shall cease to apply for appliances to which the EMC Rulebook applies.

The Rulebook “on Electrical equipment intended for use with certain voltage limits” starting from January 1, 2022 prescribes: 

  • the essential elements of safety objectives for electrical equipment and other requirements that must be met by electrical equipment supplied to the market
  • presumption of conformity
  • conformity assessment procedures for electrical equipment
  • content of technical documentation
  • mark of conformity and marking of conformity
  • declaration of conformity and model declaration of conformity and safeguard clause


According to the amendments, all provisions with regard to requirements for the conformity assessment body become invalid from January 1, 2022


Additionally, the Serbian Ministry of Economy updates provisions on formal non-compliance of electrical equipment:

Electrical equipment is considered to be formally non-compliant and, in case of non-elimination or recurrence of formal non-compliance, measures are taken in accordance with the law governing technical requirements for products and conformity assessment, if any of the following non-compliances are identified after delivery of electrical equipment:

1) absence of the mark of conformity

2) placing a mark of conformity contrary to the prescribed provisions

3) failure to make a declaration of conformity

4) drawing up a declaration of conformity contrary to the prescribed provisions

5) unavailability or incompleteness of technical documentation

6) absence, incompleteness or inaccuracy of the required information for conformity assessment procedure according to the Rulebook

7) non-fulfillment of other requirements of the Rulebook


In the EMC Rulebook, there are also the amendments that concern the permits to deliver non-CE marked electrical equipment on the territory of the Republic of Serbia. Starting from January 1, 2022 non-CE marked devices could not be put to the market of Serbia anymore. And on the day of entry into force of the ACAA agreement for electrical equipment to which the LVD Rulebook applies or, if that agreement is not concluded, on the day of accession of the Republic of Serbia to the European Union the national conformity mark shall cease to apply.
