New Energy Labelling Requirements Came into Force in Colombia

In 2015, Colombian Government through The Ministry of Mines and Energy (MINMINAS) issued Resolution № 41012. The document establishes Technical Regulations for Energy Labelling — RETIQ.

On September 28, 2018, the MINMINAS issued the Resolution № 40993 modifying requirements for the labelling. The updated law prescribes adjustments in the Energy Efficiency Label and clarifies some requirements related to air conditioning units and gas cooking appliances. It provided updates to the list of testing standards and requirements on methods for product testing.

From April 1, 2019 the Resolution reinstates the mandatory labelling requirements

 

  • Multi split air-conditioners  
  • 3 phase motors and monophase types, also known as the “Lapicero” type  
  • Air conditioning units with cooling capacity exceeding 10.540W

Label examples:

During the process of nationalization, label or its sample must be available (either its physical copy or electronic format). Label information should be written in Spanish. Additional languages are allowed on packaging.

Superintendence of Industry and Commerce (SIC) acts as a regulatory body. It is attached to the Ministry of Commerce, Industry and Tourism and responsible for monitoring the compliance of RETIQ. The organization is involved in issuing registration or import licenses for importers of the products considered in the scope of RETIQ.

Prior to import to Colombia the importers:

 

  • must show the compliance with RETIQ through obtaining a Certificate of conformity or, in permitted cases, issue Supplier’s Declaration of Conformity and labeling of product.  
  • should register in the Registry of Manufacturers and Importers of Products or import licence at the Ministry of Commerce, Industry and Tourism through the one-stop foreign trade window ("VUCE") for products that are subject to a technical regulation that requires only a certificate of conformity.  
  • have to report to the surveillance authority: the name of the producer or importer and its legal representative or agent, resident in the country, and the address for notifications, as well as the additional information determined by the regulators of the product.
