Mexico Updates Labeling Requirements for Imported Electrical Products

In Mexico, changes in the legislation took place recently and some of these changes touched on the labeling requirements for imported products. Thus, on October 1, 2020 they notify about modifications in the General Rules and Criteria towards the Foreign Trade that led to changes of 14 Official Mexican standards NOMs with regard to Commercial information.

In particular, these changes touched upon such products as electronic, electrical, and household appliances as well as all toys made with any material, including battery operated, batteries and/or any other power sources that must comply with the requirements of NOM-024-SCFI and NOM-015-SCFI respectively.

According to these amendments depending on the tariff code of a product, importers must provide documents of NOM compliance issued by authorized bodies to prove the compliance to national regulations.

Moreover, prior to these modifications, some product categories such as products for personal use, or those used by service providers and not going to be sold to consumers, items imported to the border, etc. were exempted from the NOMs requirements. Now all these categories of products must comply with the NOMs to get access to Mexico. If the product is out of the scope of a specific labeling standard, NOM-050-SCFI can be used to show the compliance of the product. In general, this standard requires from importer to provide the following information:

  • Product name
  • Quantity
  • Name or business name and address of the manufacturer or importer
  • Country of origin
  • Hazard warning
  • Instructions for use
  • Expiration date or "Best before"

Moreover, the customs stepped up efforts to inspect and surveille warehouses and retail stores. It means that inspection against the compliance of the product to the applicable NOMs can be carried out not only during the clearance procedure but also before sale to final consumers.
