European Union Implements Changes in Toys Safety Directive with Regard to Chemical Restrictions

The European Commission issued two amendments to the Directive 2009/48/EC on the safety of toys in November 2019. However, there was a transition period that allowed Member States to prepare for these amendments.

The GMA Consult Group would like to remind our subscribers that these amendments came into force from the end of May 2021. Thus, the Commission Directives (EU) 2019/1922 and (EU) 2019/1929 amended Annex II of the Directive 2009/48/EC regarding the reduction of the limits of aluminum in the composition of toys and in the materials from which toys are made, as well as the limiting values ​​of formaldehyde in toys.

The limits of aluminium have been reduced to the following:

Earlier, formaldehyde (CAS number 50-00-0) was not indicated in the Directive 2009/48/EC but it has been classified as carcinogenic category 1B under Regulation (EC) No 1272/2008. The formaldehyde may be used up to a concentration of 0,1 %, which corresponds to 1 000 mg/kg (content limit). That is why it was decided to set limiting values of formaldehyde in the TSD.

Thus, the following limiting values of formaldehyde were added to the Directive:
