EAEU Updates Procedure for Importing Products Subject to Mandatory Conformity Assessment
Soon, a new procedure for importing products subject to mandatory conformity assessment into the customs territory of the Eurasian Economic Union (EAEU) becomes effective in the EAEU. The Council of the Eurasian Economic Commission issued Decision # 130 “on the procedure for importing into the customs territory of the Eurasian Economic Union products subject to mandatory conformity assessment in the customs territory of the Eurasian Economic Union” dated by November 12, 2021. The Decision comes into effect within 60 calendar days from the date of its official publication and supersedes the Council of EEC decision # 294 dated by December 25, 2012.
The Decision applies to the following categories of products:
imported products that are included to the lists of products subject to mandatory conformity assessment against the EAEU technical regulations requirements. The compliance with technical regulation requirements is checking within the customs procedures by providing a conformity assessment document according to the EAEU technical regulation (technical regulations) requirement (such as EAEU certificate of compliance, EAEU declaration of compliance, registration (state registration) certificate, vehicle type approval (chassis type approval), etc.);
imported products that are included to the unified list of products that require mandatory conformity approval according to the mandatory requirements established within the framework of the Customs Union. The compliance should be verified by a conformity assessment document according to the relevant legislation of the Member State or a certificate of conformity or a declaration of conformity drawn up in a single form.
However, it is not required to prove the compliance with technical regulation measures when imported products are:
samples of products that are imported for research (testing) and measurements, provided that the declarant has an agreement with the conformity assessment body;
samples of products that are imported for interlaboratory comparative tests, verification or calibration of measuring instruments, comparison of standards, provided that the declarant has an agreement on such test works;
samples that will be used for the purpose of conducting research and development work;
samples (copies) of products that will be used for representative purposes as souvenirs or promotional materials;
spare parts that are imported by a duly authorized representative or by EAEU manufacturer for servicing and (or) repair of finished products previously produced and put into circulation;
components, raw materials and (or) materials for the manufacturing of products in the customs territory of the EAEU, which are imported by the manufacturer of such products or an authorized representative solely for the purposes of the declarant;
products that are imported to the address of diplomatic missions and consular offices located in the customs territory of the EAEU;
humanitarian supplies;
necessary to eliminate the consequences of natural disasters, natural and man-made emergencies;
used goods;
single copy.
Please, note that the conformity documents that require to be provided within the customs procedure can be used only by:
person indicated in such documents as the applicant
duly authorized representative of the applicant.
