United States Issues Final Rules for Made in USA Labeling

The Federal Trade Commission (FTC) issued the Final Rules 16 CFR 323 for Made in USA Labeling. The document is effective from August 13, 2021. The FTC proposed the rule for comments in Notice of Proposed Rulemaking in July 2020. After receiving hundreds of comments on this matter, the FTC slightly modified the Rule and published it in July 2021. 

The Rules concern the implementation of ‘Made in the USA’’ or ‘‘Made in America,’’ or the equivalent labeling on products marketed on the US market.

The rule will prohibit unqualified MUSA claims on labels unless: 

  • final assembly or processing of the product occurs in the United States 
  • all significant processing for the product occurs in the United States
  • all or virtually all the product’s ingredients or components are made and sourced in the United States

The Rules does not supersede or affect any other federal or state statute or regulation relating to country-of-origin labels to avoid conflict with other country-of-origin labeling laws and regulations.

The Rules also apply to mail order advertising.
