RoHS Requirements Are Coming Into Force in EAEU in March 2020

GMA Consult Group kindly reminds its subscribers to check whether your products imported to the EAEU are approved under EAEU TR 037/2016 “On the Restriction of the Use of Hazardous Substances in Electrotechnical and Radio-electronic Product” or not.

The technical regulation covers household appliances and devices, IT equipment, telecommunication facilities, lighting and office equipment, electrical tools and electrical music instruments, sports and leisure equipment, gambling and vending machines, cash registers, cable products, protective cutout devices, and other products in the electrotechnical sector.

This technical regulation restricts the content of six substances (lead, cadmium, mercury, hexavalent chromium, polybrominated biphenyls and polybrominated diphenyl ethers) in electrotechnical and radio-electronic products. Generally, the concentration of cadmium may not exceed 0.01% by weight in homogeneous materials used in electrotechnical and radio-electronic products. The other five substances should not exceed 0.1%.

This EAEU TR 037/2016 entered into force on March 1, 2018. However, according to the Decision 24 dated by February 24, 2017 on the transitional period provisions of the EAEU Technical Regulations 037/2016, the requirements will come into force on March 1, 2020.

Please, note that if a product is subject to the EAEU TR 037/2016 but was not properly approved it means that subsequent penalties will be applied in the EAEU from March 1, 2020 as the product would not show the compliance to all relevant EAEU TRs. In this case, the EAC mark can not be affixed on the product.

EAEU administrative codes prescribe punishment for the the violation of the conformity assessment procedure against EAEU TRs. In Russia for example violation of the procedure is charged with penalty that rates up to 15 000 USD with or without the confiscation of the imported products.

In this regard, we strongly recommend you to check if your product is subject to EAEU TR 037/2016 and take preventive actions before EAEU TR 037/2016 requirements come into force.
