Georgia Sets Out Technical Regulations on Safety of Toys

On January 20, 2020, the Government of Georgia adopted Decree № 47 on Approval of Technical Regulations on Safety of Toys. The regulations were prepared on top of the European Union Directive which applies to toys for children under 14.

It ensures the safety of toys and sets relevant standards and technical requirements with regard to the physical and chemical characteristics of toys. According to the Regulations, toys can be placed on the market of Georgia after their conformity assessment and documentation examination. The monitoring of the toys is going to be carried out by the Market Supervision Agency.It worth mentioning that this Agency was established only at the end of 2019 and started operations on January 1, 2020. For now, it checks toys on the market with regard to conducted tests and available documents.

Within the documentation examination, the Agency will pay attention to the availability of:

 

  • unique identification number for the toy  
  • the manufacturer's name and address  
  • trade mark (if any)  
  • instruction manual  
  • technical documentation  
  • test reports  
  • list of materials

Following that, the Agency issues recommendations which will be mandatory starting from 2021.

Currently, there are no relevant labs that allow to check mechanical and chemical properties of toys in Georgia that is why results of foreign accredited laboratories will be accepted. However, if any safety violations will be found on the market, the appropriate actions will be imposed up to product recall from the market.

Please, note that second-hand toys should also have certificates of conformity, laboratory test results, and other necessary documents that show the compliance with safety requirements.

We kindly remind that it a one-year period is given to prepare for the regulations. Thus, sanctions will not apply until 2021. The Agency will only give recommendations to companies to eliminate violations.
