European Union Significantly Changes General Product Safety Directive

After the EU market analysis in 2019, more than 2000 dangerous products was identified on the market. It made the EU commission think about reviewing the General Product Safety Directive 2001/95/EC (GPSD) as the current version of the GPSD does not take into account such products that use Artificial Intelligence or control of the products that are sold through the online market.

In this regard, The Commission's Directorate-General for Justice and Consumers (DG GUST) put forward an initiative on the GPSD review and the EU Commission opens the public consultation and seeks for feedback on the published combined roadmap/inception impact assessment.

Thus, stakeholders can send their suggestions through the report feedback until September 1, 2020. The Commission will summarise all the received reports explaining how and why this information will be implemented or rejected within the review procedure.

Public consultations are open until October 6, 2020 and allow the public to express their view on provisions of the EU laws and policies.

Thus, the GPSD review procedure is aimed to:

  • ensure that the EU legal framework provides general safety rules for all consumer products and risks including those related to new technologies
  • solve issues connected with the online sales platforms
  • make product recalls more effective
  • increase market surveillance
  • ensure better coordination of rules for harmonised and non-harmonised consumer products

Information on the GPSD review is available here.
